What has been your most memorable civil litigation case? Frances L. Cox v. Commonwealth of Virginia, 227 Va. 324, 315 S.E.2d 228 (1984). Working with former partner Jack Rust on my first and only felony criminal appeal arising from the September 1982 embezzlement conviction of Fairfax City Treasurer Frances L. Cox. We argued she had been denied the right to “call for evidence in [her] favor,” which includes the right to prepare for trial and the “right to interview material witnesses and ascertain the truth.” In a unanimous opinion, the Supreme Court of Virginia reversed the conviction and remanded for a new trial. For 35 years, Cox has been cited as a leading case for the proposition that denying access to material financial records amounts to a violation of constitutional rights.
