Is the growing national debate about environmental issues creating uncertainty for your clients? Yes, for some of them. Recent changes being made by EPA are causing clients to wonder whether they will be affected in Virginia. One example relates to EPA’s recent repeal of the federal Clean Water Rule, which relates to the definition of “waters of the United States” and specifically what types of wetlands will be federally regulated.

Has Virginia’s Voluntary Remediation Program been successful in returning facilities to productive use? Yes. Virginia’s brownfields program, which includes the VRP, provides a great opportunity for developers to restore properties with potential or known environmental contamination without the risk of liability. The VRP’s nonenforcement-based program provides flexibility by using a risk-based approach that often allows for institutional controls instead of traditional remediation.
